    Idealism vs realism there. Real life isn't fair and school (at least the US public school system) is a load of regurgitating squat that if you got one or two good teachers that actually got through to you about how to think rather than what to think you were lucky.

    No.

    Some Nations laws supersede any contract. In some places in the world the end user is far more 'protected' and it's local laws overwrite any contract. In essence, someone could agree to this and the agreement would be null and void by local laws.

    Firstly, My dearest sympathies to those unable to win in this contest.
    Why would the
    Turbine Team go to such lengths to hurt you outside The States? Because they are All Shadar-Kai and revel in your Pain! Not really, they already have some designs, it shows some and this is a short contest ending on the 22nd.
    They don't NEED addition designers, they have employees with talent and resources not commonly available to the average person. It certainly wasn't envisioned to isolate or belittle others with contest restrictions.
    It's a PR awareness contest to hype up
    Shadowfell Conspiracy content and possibly acquire new accounts.
    The person or people responsible for thinking up this contest most likely were
    Not the person or people
    responsible for setting the contest restrictions or company, state and/or international bylines.
    I Fully agree with the concept that many people are myopic in their daily outlook of life and strain to think that everyone and everything is not for/or against them.
    Typically I understand that my life and its passing, in the scheme of things will go completely
    unnoticed and unmarked. Unless i'm totally wrong and my life is not my own.

    Being unable to collect the prize "Win", doesn't Actually keep anyone from participating in this contest, if you love the game it certainly shouldn't stop anyone from submitting something better than many iv'e already seen today. A side note, as a Dr. Who fan since 1978, (Thank you BBC & PBS!) it has never stopped me from loving the show. But, it hurts awful that i cant play/participate/watch etc. anything based in the UK because of web/Viewing restrictions.(like Christmas episodes that don't come here til like Summer )
    Yet, i don't blame them, it is what it is.

    The entry pending seems to be broken or something, Or whoever is accepting the entries is lazy, see quite a few pictures that either are multicolored (rules said single color), or arent tattoos at all (Seen 1-2 pictures of a person,... no tattoo in sight)

    First of all I think this is a great idea for a contest. I look forward to see the winning entries.

    While I am a little bit disappointed that it's not available for non US-citizen, I can understand their decision. I will try to point out why I am not mad at Turbine for this:

    The restriction to US artists is probably because of the difference how copyright works in US and most European countries. In the US the sponsor usually gets the copyright for a requested piece of art. In Europe the copyright always belongs to the artist. The copyright cannot be sold or given away even if the artist wanted. So Turbine would never be able to "own" an art produced by a European artist.

    They can be given the rights to use it, but since the specific laws depend on the state, this will be quite a bit of work for their legal department, as others already pointed out.

    You are wrong, in absolutely every particular relevant to this contest. The criteria for assertion of copyright holders' rights are identical in every state. The "sponsor" doesn't ever get the copyright in the US for a requested piece of art unless it constitutes a "work for hire". In this case, it is in fact clearly a work for hire, which is also covered in (for all practical purposes) exactly the same way by every country which is a signatory to the Berne Conventio. This means it is no more problematic, in any way, to open the contest up to the rest of the world. Copyright is territorial, and the costs are borne by the person making the accusation of infringement, so even a citizen of a country that isn't a signatory wouldn't have a prayer: even if there are jurisdictions in which a clear work-for-hire isn't honoured, which I don't believe, they have to make their case stick in the States.

    And even if - IF - someone could make a case that this is NOT a work-for-hire, Turbine can cover themselves for free by writing a transfer in perpetuity into the terms and conditions or insisting up-front upon an appropriate Creative Commons license from the winner, and US law is the only law that matters as it's the US territory in which it would be enforced.

    Once again, This Is Not About Intellectual Property. This is about the fact that the prize is a computer, which could impose an import duty on the recipient, and/or cause Turbine to incur liability which they cannot necessarily legally limit in other nations. If the prize were Turbine Points (or something good, like a mod which lets the winner access Devotion enhancement as a Ranger or Pally under the new enhancement system), there would be no issue.
